• Usage data — log data, device information, IP address, and how you interact with the platform.
• AI feature data — if you enable optional EKON AI features, the information those features process and generate, as described in Section 04.

02How We Use Your Information

We use your information to:

• Provide, operate, and maintain the CRM platform and its features.
• Set up, configure, and register your account (including A2P 10DLC registration).
• Process payments and manage your subscription.
• Send service-related communications, updates, and support responses.
• Provide optional EKON AI features where you have enabled them (see Section 04).
• Improve our platform and develop new features.
• Comply with legal obligations and enforce our terms.

03How We Share Your Information

We do not sell your personal information. We share information only with service providers and as required by law:

• GoHighLevel — our underlying CRM infrastructure, which processes your account, contact, and communication data.
• Payment processors — to securely handle billing and subscription payments.
• AI and automation providers — AI and automation providers, including CloseBot where enabled, may process relevant CRM and communication data solely to provide configured EKON AI functionality.
• Calendly — when you book a demo or onboarding call.
• Analytics providers — to understand how the platform and website are used.
• Legal and compliance — when required by law, subpoena, or to protect our rights and users.

04Optional AI Features (EKON AI)

EKON AI is an optional set of features, offered as EKON AI Lead Screener, EKON AI Operations Manager, and EKON AI Complete. What AI processes depends on which configuration and features you enable:

• EKON AI Lead Screener — seller communications, seller and property information, and qualification context reasonably required to provide enabled Positive Reply screening features.
• EKON AI Operations Manager — where enabled, relevant Acquisitions CRM context, Follow Up context, Dispositions context, seller communications, buyer communications, CRM activity, and call transcripts.
• EKON AI Complete — the information reasonably necessary to provide both EKON AI Lead Screener and EKON AI Operations Manager.

Depending on the features enabled, this may include:

• Seller communications and SMS conversation content.
• Call transcripts, where call features are enabled.
• Lead and contact information, property information, and CRM activity.
• Qualification information and conversation summaries.
• Seller communication preferences.
• AI-generated summaries and CRM field suggestions or updates.

Where enabled, AI may be used to:

• Screen and qualify positive seller replies and assist seller conversations.
• Summarize communications and extract information sellers provide.
• Assist qualification and populate CRM fields.
• Recommend Follow Up and create personalized Follow Up.
• Assist Acquisitions, Follow Up, and Dispositions workflows, including buyer conversations, where enabled.

AI features are processed by EKON and its AI and automation service providers, including CloseBot where enabled, solely to provide the configured EKON AI functionality (see Section 03). We do not sell your personal information, including information processed by AI features. If you do not enable EKON AI, these features do not process your data. If you enable only certain EKON AI modules, processing is limited to the data reasonably needed to provide those enabled features.

05Cookies & Tracking

Our website uses cookies and similar technologies to remember preferences, measure traffic, and improve your experience. You can control cookies through your browser settings, though some features may not function properly if disabled.

06Data Retention

We retain your information for as long as your account is active and as needed to provide the service. After cancellation, we may retain certain data as required for legal, tax, accounting, or compliance purposes, after which it is deleted or anonymized.

07Your Rights

08Children's Privacy

EKON CRM is intended for use by adults operating a business. We do not knowingly collect personal information from anyone under the age of 18. If you believe a minor has provided us information, contact us at support@ekoncrm.com and we will take steps to remove it.

Our website and platform may contain links to third-party sites and services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their policies.

10Security

We use reasonable administrative, technical, and physical safeguards to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
