These Terms of Use ("Terms") govern your access to and use of the EKON CRM platform and website, operated by EKON Investments LLC ("EKON CRM," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
By accessing or using EKON CRM, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time, and continued use after changes constitutes acceptance.
EKON CRM is a done-for-you customer relationship management platform built for real estate wholesalers, powered by GoHighLevel. The service includes:
EKON AI is optional and available only where enabled for your account. It is planned in three configurations: EKON AI Lead Screener, EKON AI Operations Manager, and EKON AI Complete. EKON AI Complete includes both EKON AI Lead Screener and EKON AI Operations Manager. EKON AI is not yet generally available, and availability may be limited during Early Access. Optional EKON AI features may be offered under separate subscription, setup, and usage terms. Applicable pricing and usage limits will be disclosed to the customer before enrollment or purchase. EKON AI is layered into your existing EKON CRM account; the functionality provided, and the data processed, depend on the AI configuration and features enabled for your account.
EKON AI Lead Screener focuses on screening and qualifying positive seller replies. It is not designed to respond to every inbound message; replies such as negatives, opt-outs, and wrong numbers are handled by the platform's standard automations and compliance tools. Where enabled, EKON AI Lead Screener may provide AI-assisted conversations with sellers whose replies have been identified as positive, seller qualification assistance, CRM field extraction and updates, detection of call or callback requests, and handoff to your team. In providing these features, it may process seller SMS conversations, lead and contact information, qualification information, and seller context.
EKON AI Operations Manager works on leads that have entered the operating side of your business and, where enabled, may provide AI assistance in:
Where enabled, EKON AI Operations Manager may process CRM records and activity, Acquisitions, Follow Up, and Dispositions context, seller and buyer communications, call transcripts, pipeline information, and other operational context reasonably required for the enabled AI features. EKON AI Complete may process the information reasonably necessary to provide both EKON AI Lead Screener and EKON AI Operations Manager.
By using EKON AI, you acknowledge and agree that:
You must be at least 18 years old and able to form a legally binding contract to use EKON CRM. By using the service, you represent that you meet these requirements and that the information you provide is accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. You are responsible for the accuracy and legality of all data you import or send through the platform.
EKON CRM is offered on a monthly subscription basis:
Optional EKON AI products (EKON AI Lead Screener, EKON AI Operations Manager, and EKON AI Complete) are not yet generally available. Availability may be limited during Early Access, and final pricing and usage terms for EKON AI will be disclosed before purchase.
Subscriptions are billed monthly in advance and automatically renew until cancelled. You may cancel at any time, effective at the end of your current billing period. There are no long-term contracts.
EKON may introduce optional features or additional subscription tiers in the future. Pricing and applicable terms will be disclosed before purchase.
Plans displayed as Coming Soon are not available for purchase until activated by EKON. Features displayed as Early Access, including EKON AI, are not available through automated checkout; they may be offered to approved customers through manual onboarding, at the prices disclosed on our site at the time of enrollment.
A one-time $350 setup and build fee is charged when the account is created. This covers initial CRM configuration, workflows, campaigns, A2P/10DLC assistance, and onboarding. The setup fee is non-recurring and is separate from your monthly subscription.
Subscription fees and applicable usage-based charges (described below) are billed separately.
Communication usage is billed separately from your subscription, based on your actual usage, at the rates displayed:
These communication rates reflect underlying carrier and provider costs and may change if those costs change. You are responsible for maintaining a sufficient balance to send communications.
EKON AI. Pricing and usage terms for EKON AI, including any included usage or usage-based charges, will be disclosed before purchase. Standard communication charges apply to messages sent through the platform, including messages sent with the help of EKON AI.
Monthly subscription fees are non-refundable for the current billing period. When you cancel, you retain access through the end of the period you have paid for. Usage-based charges already incurred are non-refundable.
We handle your A2P 10DLC registration as part of your setup and build. Registrations are typically approved in around 48 hours, but carrier review timelines are controlled by mobile carriers and third parties and are not guaranteed.
You are solely responsible for using the platform's messaging and calling tools in compliance with all applicable laws and regulations, including the TCPA, TSR, CAN-SPAM, state wholesaling and telemarketing laws, and carrier policies. You agree to obtain all required consents and to honor opt-out requests.
You agree not to use EKON CRM to send unlawful, deceptive, harassing, or unsolicited communications in violation of applicable law, to transmit malware, to infringe others' rights, or to attempt to disrupt or reverse-engineer the platform. We may suspend or terminate accounts that violate these Terms or that create compliance or carrier risk.
The EKON CRM platform configuration, branding, templates, and materials are the property of EKON Investments LLC or its licensors. You retain ownership of your own data and contacts. We grant you a limited, non-exclusive, non-transferable license to use the service while your subscription is active.
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee specific business results, deal volume, deliverability, or carrier approval times. To the maximum extent permitted by law, EKON Investments LLC is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the three months preceding the claim.
We may modify these Terms at any time by posting an updated version with a new "Last updated" date. These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Questions about these Terms can be sent to support@ekoncrm.com.
