These Terms of Use ("Terms") govern your access to and use of the EKON CRM platform and website, operated by EKON Investments LLC ("EKON CRM," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
By accessing or using EKON CRM, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time, and continued use after changes constitutes acceptance.
EKON CRM is a done-for-you customer relationship management platform built for real estate wholesalers, powered by GoHighLevel. The service includes:
You must be at least 18 years old and able to form a legally binding contract to use EKON CRM. By using the service, you represent that you meet these requirements and that the information you provide is accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. You are responsible for the accuracy and legality of all data you import or send through the platform.
EKON CRM is offered on a monthly subscription basis:
Subscriptions are billed monthly in advance and automatically renew until cancelled. You may cancel at any time, effective at the end of your current billing period. There are no long-term contracts.
EKON CRM does not charge a setup fee on either plan. Your monthly subscription includes the full done-for-you build, onboarding, and A2P registration.
Your monthly price is the only recurring platform charge. Usage-based charges (described below) are separate and billed at cost.
Outreach is billed at cost, separate from your subscription, based on your actual usage:
These rates reflect underlying carrier and provider costs and may change if those costs change. You are responsible for maintaining a sufficient balance to send communications.
Monthly subscription fees are non-refundable for the current billing period. When you cancel, you retain access through the end of the period you have paid for. Usage-based charges already incurred are non-refundable.
We handle your A2P 10DLC registration as part of your plan. Registrations are typically live in about 48 hours, but carrier review timelines are controlled by mobile carriers and third parties and are not guaranteed.
You are solely responsible for using the platform's messaging and calling tools in compliance with all applicable laws and regulations, including the TCPA, TSR, CAN-SPAM, state wholesaling and telemarketing laws, and carrier policies. You agree to obtain all required consents and to honor opt-out requests.
You agree not to use EKON CRM to send unlawful, deceptive, harassing, or unsolicited communications in violation of applicable law, to transmit malware, to infringe others' rights, or to attempt to disrupt or reverse-engineer the platform. We may suspend or terminate accounts that violate these Terms or that create compliance or carrier risk.
The EKON CRM platform configuration, branding, templates, and materials are the property of EKON Investments LLC or its licensors. You retain ownership of your own data and contacts. We grant you a limited, non-exclusive, non-transferable license to use the service while your subscription is active.
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee specific business results, deal volume, deliverability, or carrier approval times. To the maximum extent permitted by law, EKON Investments LLC is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the three months preceding the claim.
We may modify these Terms at any time by posting an updated version with a new "Last updated" date. These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Questions about these Terms can be sent to support@ekoncrm.com.
